1. Agreement to Terms

These Terms and Conditions ("Terms") form a legally binding agreement between you and Corvidae Limited (New Zealand) ("Corvidae", "we", "us", "our") relating to your access to and use of SnapKai (the "Service").

By accessing or using the Service, you agree to these Terms. If you do not agree, you must not use the Service.

2. Description of the Service

SnapKai is a food logging app. It helps you record what you eat and tracks calories, macros, weight, and related trends. The Service includes:

  • AI analysis of meal photos (food identification and portion, calorie, and macro estimates)
  • AI reading of nutrition information panels ("label scans")
  • Barcode lookup against a shared New Zealand product database (free)
  • Manual entry, repeating meals, and favourites (free)
  • Daily reports, 7 and 30-day trends, weight tracking, and streaks (free)
  • An installable web app (PWA) that works on any modern phone

SnapKai is not a medical service. It does not provide medical, dietetic, or nutritional advice, and it is not a substitute for advice from a qualified health professional. If you have a medical condition, an eating disorder, or specific dietary requirements, consult a professional before relying on any food tracking tool.

3. User Accounts

3.1 Account Creation

To use the Service you must create an account, using your email and password or a third-party sign-in (Google or Microsoft). You agree to provide accurate information, keep your credentials secure, accept responsibility for activity under your account, and notify us promptly of any unauthorised access.

3.2 Eligibility

You must be at least 16 years old to use the Service. By creating an account, you represent that you meet this age requirement.

4. Credits, Pricing, and Payments

4.1 What's free

Barcode scanning, manual entry, repeating meals, favourites, reports, trends, weight tracking, and streaks are free. New accounts receive 30 free credits. We reserve the right to modify features, but we commit that barcode scanning and manual logging remain free.

4.2 Credits

  • Credits pay for AI features only: a meal photo analysis costs 2 credits and a nutrition label scan costs 1 credit (current rates, shown in the app before each action if they ever change).
  • Credits never expire.
  • Failed scans are refunded: if an AI scan returns nothing useful, the credit is returned automatically or via the one-tap refund on the result screen. Refund-abuse (systematically claiming refunds on usable results) may be investigated.
  • Credits are personal to your account, are not transferable, and have no cash value except as required by law.

4.3 One-off payments — nothing auto-renews

  • All prices are in New Zealand dollars and include GST.
  • Credit packs and the Year Pass are one-off purchases. Nothing you buy from us auto-renews, and we never store a recurring billing authority.
  • The Year Pass provides 12 months of unlimited AI scans from the date of purchase, subject to a fair-use limit (currently 10 AI scans per day). When it expires it simply ends — no charge, no renewal.
  • Payments are processed by Stripe; we do not store your full card details.
  • We may change pricing for future purchases at any time; changes never affect credits you already own.

4.4 Refunds

Failed scan credits are always refunded (4.2). For purchase refunds, contact us within 14 days of purchase — if you have used only a small portion of a pack, we will generally refund the purchase. Nothing in these Terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.

5. Acceptable Use

You agree NOT to:

  • Use automated systems (bots, scrapers) to access the Service or bulk-submit scans
  • Deliberately submit misleading data to the shared NZ product database
  • Attempt to reverse engineer, decompile, or extract source code
  • Interfere with or disrupt the Service or servers
  • Upload malicious code or harmful materials
  • Resell, redistribute, or commercialise the Service without authorisation
  • Violate any applicable laws or the rights of others

We may investigate suspected misuse and may suspend or terminate access to protect the Service, its users, and our rights.

6. Your Content and the Product Database

6.1 Your food log

You retain all rights to your food log and personal data. You grant us a limited licence to process it solely to provide the Service. This licence ends when you delete your data or account. Meal photos are processed and discarded, not stored (see our Privacy Policy).

6.2 Product data contributions

When you confirm a nutrition label scan, the product-level data (name, barcode, nutrition panel values — nothing personal) may be added to SnapKai's shared New Zealand product database to give all users free barcode matches. You grant us a perpetual, royalty-free licence to use that product data for this purpose.

7. AI Estimates — Disclaimers

  • AI food identification and portion estimates are estimates, typically within a meaningful margin of error (portion estimates commonly vary ±20–30%). Confidence is shown, and you can edit every result before saving.
  • Nutrition data from labels and databases may contain errors or be out of date; manufacturers change recipes.
  • You are responsible for verifying information that matters to your health (for example allergen or medical-diet decisions must never rely on SnapKai output).

8. Service Availability

The Service is provided "as is" and "as available". We do not guarantee uninterrupted or error-free operation, specific health or weight outcomes, or compatibility with every device. The Service relies on third-party providers (AWS hosting, AI processing via Amazon Bedrock running Anthropic Claude models, Stripe payments, Cloudflare Turnstile); we are not responsible for their availability but choose reputable providers with appropriate safeguards.

9. Limitation of Liability

To the fullest extent permitted by law, Corvidae will not be liable for any indirect, incidental, special, or consequential damages; loss of data or profits; or health outcomes arising from reliance on estimates. Our total aggregate liability arising out of or in connection with the Service will not exceed the amount you paid us in the 12 months preceding the event giving rise to the claim, or NZD $100 if you have paid nothing in that period.

Nothing in these Terms limits rights you have under New Zealand consumer law (including the Consumer Guarantees Act 1993) or other applicable laws that cannot be excluded.

10. Termination

You may delete your account at any time — one tap in Settings, which also deletes your data. We may suspend or terminate access for violation of these Terms, fraud, or abuse. If we terminate your account other than for cause, we will refund the value of unused credits.

11. Changes to Terms

We may modify these Terms at any time. We will notify users of significant changes via email or through the Service. Your continued use after changes constitutes acceptance. We will never use a terms change to convert a one-off purchase into a recurring one.

12. Governing Law and Disputes

These Terms are governed by the laws of New Zealand. If you have a dispute with us, please contact us first — we genuinely try to fix things. Failing informal resolution, any legal action must be brought in the courts of New Zealand.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force and effect.
